Terms of Service & Client Agreement

Introduction
Welcome to Assessment Now. These Terms of Service & Client Agreement (“Agreement”) govern your use of our website and the professional assessment services provided by Assessment Now. By scheduling an appointment, purchasing services, completing assessment materials, or otherwise engaging with Assessment Now, you acknowledge that you have read, understood, and agree to these Terms.Our goal is to provide timely, objective, and professional assessment services while maintaining the highest standards of clinical integrity, confidentiality, and client care. This Agreement explains our services, your responsibilities as a client, and the expectations that help ensure a successful assessment process.
Definitions
For purposes of this Agreement: Assessment Now, we, our, or us refers to Assessment Now and its clinicians, contractors, employees, and authorized representatives. Client, you, or your refers to any individual receiving services from Assessment Now. Assessment Services include clinical interviews, behavioral health and substance use assessments, standardized screening and assessment instruments, consultation related to an evaluation, written reports, and other professional assessment services offered by Assessment Now.
Third Party refers to any person or organization outside Assessment Now, including attorneys, courts, probation departments, employers, schools, healthcare providers, licensing boards, or other authorized recipients.
About Assessment Now
Assessment Now provides professional behavioral health and substance use assessments for individuals, attorneys, employers, agencies, courts, and other organizations requiring objective clinical evaluations.
Our evaluations are based on accepted clinical standards, available information, written screening instruments, clinical interviews, and the evaluator’s professional judgment. Every assessment is conducted independently and tailored to the purpose of the referral.Assessment Now is committed to providing professional, respectful, and timely services while recognizing that every client’s circumstances are unique.
Scope of Services
Assessment Now provides professional assessment and evaluation services. Unless otherwise agreed in writing, our services are limited to assessments, professional consultation related to those assessments, and associated written reports. Each evaluation is conducted for a specific purpose and is designed to address the referral questions relevant to that evaluation. Assessment Now does not provide ongoing psychotherapy, counseling, case management, legal representation, emergency mental health services, or crisis intervention as part of the assessment process. Individuals experiencing a medical or mental health emergency should immediately contact 911, proceed to the nearest emergency department, or contact the appropriate emergency or crisis resources available in their community. Assessment Now primarily serves adults. Assessment services for adolescents or minors may be provided when appropriate and when all applicable legal requirements, including parental or guardian consent when required by law, have been satisfied.
Eligibility for Services
Clients are responsible for ensuring they are legally authorized to obtain assessment services. Assessment Now may request identification or other documentation when appropriate to verify a client’s identity. Assessment Now reserves the right to decline, postpone, or discontinue services when necessary, including situations involving safety concerns, inability to verify identity, failure to participate meaningfully in the assessment process, circumstances outside the scope of our practice, or any other situation in which we determine we cannot provide services responsibly or maintain an appropriate professional relationship.
When services are discontinued, any refund, including a full or partial refund, will be considered on a case-by-case basis, taking into account the circumstances and any services already provided.
Scheduling, Payment, & Cancellations
Appointments are scheduled in advance and are generally conducted remotely unless other arrangements have been made. Payment is due according to the terms provided during scheduling or invoicing. Assessment Now reserves the right to postpone services until required payment has been received.
Clients are responsible for arriving on time, completing required paperwork, and providing requested documentation before their appointment whenever reasonably possible. Appointments may be rescheduled or cancelled by either party when necessary. Refund eligibility, cancellation deadlines, and related conditions are described in our separate Refund Policy, which is incorporated into this Agreement by reference. A $50 fee may be charged when a client misses a scheduled appointment or cancels without providing at least 24 hours’ notice. Assessment Now may waive this fee at its discretion based on the circumstances. Any outstanding missed-appointment fee may be required to be paid before another appointment is scheduled.
Remote Assessment Services
Many Assessment Now services are provided remotely using secure communication technology.
Clients are responsible for participating from a private location with a reliable internet connection and a device capable of supporting the assessment process. Technical difficulties, interruptions, or an environment that prevents a meaningful evaluation may require an appointment to be rescheduled or completed at another time.
Client Responsibilities
To promote an accurate and meaningful evaluation, clients agree to:

Provide accurate and complete information to the best of their knowledge.

Complete all required forms, questionnaires, and assessment instruments honestly.

Participate fully and honestly throughout the assessment process.

Promptly provide records, releases, or other documentation requested for the evaluation.

Notify Assessment Now of any significant changes that may affect the assessment process.
Knowingly providing false, incomplete, or misleading information may affect the conclusions of the evaluation and may result in services being declined or discontinued. Assessment Now is committed to maintaining respectful, professional communication with every client. We ask clients to extend the same courtesy to our staff and clinicians. Abusive, threatening, discriminatory, or harassing behavior may result in services being declined or discontinued.
Our Professional Responsibilities
Assessment Now is committed to providing professional, objective, and respectful assessment services consistent with applicable laws, ethical standards, and accepted clinical practices. Each evaluation includes a clinical interview and one or more standardized written screening or assessment instruments. Additional assessment methods may be used when clinically appropriate based on the purpose and complexity of the evaluation. Reports reflect the information available at the time of the evaluation and the evaluator’s independent professional judgment.
Clinical Independence & Professional Judgment
Assessment Now provides independent clinical opinions based on the information available during the evaluation. Assessment findings and recommendations are not influenced by a client’s desired outcome or the preferences of attorneys, employers, referral sources, family members, or other interested parties. Completion of an assessment does not guarantee a particular diagnosis, recommendation, legal outcome, employment decision, licensing decision, or acceptance by any third party. If relevant information becomes available after an evaluation has been completed, Assessment Now may determine that clarification, revision, or no change to the evaluation is appropriate based upon its professional judgment.
Report Turnaround Guarantee
Assessment Now is committed to providing timely assessment services. Unless otherwise stated in writing, completed evaluation reports are generally delivered within five (5) business days after all of the following have been received:

The assessment consultation has been completed.

All required payment has been received.

Required documentation, releases, and supporting information have been provided.

The evaluator has determined that sufficient information is available to complete the report.
The five-business-day turnaround period begins on the first business day after these requirements have been satisfied. If additional information, records, clarification, or documentation is needed after the assessment, the turnaround period may be extended until the requested information has been received.
Certain specialized evaluations, including Department of Transportation (DOT) Substance Abuse Professional (SAP) services or other evaluations requiring additional regulatory review or documentation, may be subject to different completion timelines. When applicable, those timelines will be communicated during scheduling.
While Assessment Now strives to meet every stated turnaround time, circumstances outside our reasonable control—including technology failures, severe weather, illness, or other unforeseen events—may occasionally require additional time. If this occurs, we will make reasonable efforts to notify affected clients promptly.
Reports & Report Delivery
Assessment reports are prepared for the specific purpose of the referral and reflect the evaluator’s professional opinion based on the information available at the time of the evaluation. Unless otherwise required by law or previously authorized, completed reports are generally provided to the client first. Clients may then authorize Assessment Now to release the report to attorneys, employers, courts, probation departments, healthcare providers, or other third parties as appropriate. Assessment Now is not responsible for decisions made by third parties based upon the contents of an evaluation report.
Confidentiality
Assessment Now respects client privacy and handles confidential information in accordance with applicable federal and state laws, professional standards, and our Privacy Policy.
Information obtained during an assessment may be disclosed when:

The client provides appropriate written authorization;

Disclosure is required or permitted by applicable law;

Disclosure is necessary to comply with a valid court order or other legal requirement;

Mandatory reporting laws apply; or
-
Disclosure is necessary to address a serious threat to the health or safety of the client or others.

Recording
Assessment sessions may be recorded by Assessment Now when appropriate and when permitted by applicable law and professional standards. Clients may not record assessment sessions, interviews, or other communications with Assessment Now without our prior written consent.
Refund Summary
Assessment Now’s refund policies, eligibility requirements, timelines, and limitations are described in our separate Refund Policy, which is incorporated into this Agreement by reference. Clients are encouraged to review the Refund Policy before scheduling services.
Website Use & Intellectual Property
All content available on the Assessment Now website, including text, graphics, logos, branding, forms, documents, and other materials, is the property of Assessment Now or its licensors and is protected by applicable intellectual property laws. Website content is provided for general informational purposes only and should not be considered individualized clinical, medical, or legal advice. Users may not reproduce, distribute, modify, or commercially use website content without prior written permission unless otherwise permitted by law.
Limitation of Liability
Assessment Now provides professional opinions based upon the information reasonably available during the evaluation process. No assessment can guarantee a particular diagnosis, recommendation, legal outcome, employment decision, licensing decision, or acceptance by a third party.To the fullest extent permitted by law, Assessment Now’s liability arising from the use of its website or professional services shall be limited to the amount paid by the client for the specific service giving rise to the claim.Nothing in this Agreement limits rights that cannot legally be limited under applicable law.
Changes to this Agreement
Assessment Now may update these Terms of Service & Client Agreement from time to time to reflect changes in our services, applicable laws, or business practices. Updated versions will be posted on this website with a revised Last Updated date. Continued use of our website or services after changes become effective constitutes acceptance of the revised Terms.
Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Ohio, without regard to its conflict of law principles. Assessment Now may provide services to individuals located outside Ohio when legally and professionally appropriate. However, we reserve the right to decline services when licensing requirements, jurisdictional restrictions, or other legal considerations prevent us from providing services.
