When a DOT violation occurs, this becomes an immediate issue for both the employee and the employer. Upon failing a DOT chemical test, an employee (or owner-operator) is required by law to stop all safety-sensitive duties until they’ve gone through a evaluation process with a DOT-accredited professional - this individual is referred to as a SAP (Substance Abuse Professional). Since 2020, Assessment Now has been providing DOT-conforming SAP evaluations to:
-
Truck drivers/CDL holders
-
Heavy equipment operators
-
Pilots & air traffic controllers
-
Pipeline workers
-
HAZMAT workers
-
FRA & all other DOT safety-sensitive employees
Steps to obtaining a DOT/SAP evaluation and get back to work as soon possible:
Schedule an Initial Assessment - Upon paying for your assessment, pick a time that works best for you to meet with one of our SAPs. Make sure you choose a SAP credentialed assessor when you schedule using our convenient online calendar tool.
Register On FMCSA Clearinghouse & Designate a SAP Prior to Your Appointment - this step applies to CDL holders only. FMCSA requires that CDL drivers report who they’ve chosen to be their SAP.
Orientation - Watch our 5-minute SAP orientation video and fill out an easy to use drug and alcohol questionnaire on your own time.
Interview - Complete a 30-60 minute interview with an evaluator via video conference. NOTE: Online/remote services by videoconference are allowed by Office of Drug & Alcohol Policy & Compliance only when the CDL or other license holder is evaluated within the state that are currently reside in.
Complete Education or Treatment - the DOT requires that a SAP prescribe at least 4-hours of drug and alcohol education to the license holder before they become eligible to return to work.
Schedule & Attende a Compliance Meeting - in an effort ensure readiness for return to work, DOT guidelines require all SAPs meet with the CDL driver or other DOT-endorsed license holder on a second occasion. The primary function of this is to ensure the employee has fulfilled their education or treatment requirement and understands what needs to be done to return to work.
Complete a RTD Test - the last thing that always needs to be done before returning to your safety sensitive position is a RTD (return to duty) drug test. Rather than completing “pre-employment test”, your employer will ask you to take an RTD test. The SAP’s last duty is to provide various documents to the employer which help conclude and affirm completion of the remediative SAP process.
